Umno’s withdrawal of suit against Tian Chua over Lahad Datu incursion is wrong, says Utusan

The withdrawal of its lawsuit against Batu MP Tian Chua (pic) shows that Umno had been half-hearted in seeking justice for those who perished in last year's Lahad Datu incursion, said Mingguan Malaysia, the weekend edition of Utusan Malaysia.
The newspaper's editor Ku Seman Ku Hussain said the withdrawal of the lawsuit portrayed Umno as being insensitive to those who had sacrificed their lives during the Lahad Datu incursion in February last year.
"Even if Umno were to lose in court, they would still be winners in the eyes of the rakyat. But now, the bell has not even sounded and an agreement has been struck outside the ring.
"Is it because the 13th general election is done and dusted, so a lawsuit against Tian Chua does not have any political mileage to garner the rakyat's support?
"Can the lives of our security personnel, the country's pride and the safety of the rakyat be exchanged for a simple apology from Tian Chua?" Ku Seman asked.
"Moreover, the apology was not made officially by Tian Chua in a public space," he added.
On January 13, Parti Keadilan Rakyat vice-president Chua Tian Chang, or Tian Chua, expressed regret over his comments about the Lahad Datu incursion and agreed to withdraw them.
His admission prompted Umno to withdraw a suit against him and two others at the Kuala Lumpur High Court. The case had initially been set for hearing on January 13.
Umno's decision was delivered in chambers before judicial commissioner Rosilah Yop. The suit had been filed in March last year by Umno executive secretary Datuk Ab Rauf Yusoh.
Besides Tian Chua, the other two defendants who were named in the suit were KeadilanDaily.com editor Fazallah Pit and the writer of the article, Aisha Geoffrey.
Tian Chua clarified that he had never intended to imply that Umno had been the planner behind the Lahad Datu incursion.
Umno legal adviser Datuk Mohd Hafarizam Harun told Utusan Malaysia that the withdrawal of the suit did not mean that Umno took the rakyat's views lightly.
"When Umno decided to take legal action against Tian Chua for his comments, it showed its eagerness in not politicising the Lahad Datu incursion," Ku Seman said.
"The rakyat had risen to put pressure on Tian Chua when the number of Malaysian security personnel fatalities rose. They felt that Tian Chua had crossed the line with his remarks.
"But when Umno decided to withdraw the lawsuit after Tian Chua apologised, it showed that the party was not wholehearted," Ku Seman said.
"The nation, except for a few useless Malaysians, mourned when our brave security personnel fell in battle against the armed Sulu terrorists," Ku Seman said.
He said when Umno filed the lawsuit, the party should have pursued it with the same zeal and commitment shown by the Malaysian security personnel in Lahad Datu.
